TAIPEI (TVBS News) — An official from the Presidential Office confirmed on Thursday (Jan. 2) that the president has approved the Executive Yuan's (行政院) request to send the amended "Constitutional Court Procedure Act" (憲法訴訟法) back to the Legislative Yuan (立法院) for reconsideration. This decision follows concerns over the amendments passed on Dec. 20, which may hinder the Constitutional Court's (憲法法庭) operations.
Presidential Office Spokesperson Kuo Ya-hui (郭雅慧) stated that the Executive Yuan has reported to the president that the amendments could significantly impact the Constitutional Court, potentially jeopardizing its function of reviewing unconstitutional matters. Kuo emphasized that the president approved the Executive Yuan's reconsideration request based on procedural regulations outlined in the "Additional Articles of the Constitution" (憲法增修條文).
The president believes that exercising judicial power by the Constitutional Court is crucial for maintaining the nation's constitutional order and safeguarding citizens' fundamental rights. The president hopes that the mechanism established by the Constitution will allow political parties in the Legislative Yuan to re-evaluate the bill's content. Kuo stressed the constitutional controversy surrounding the amendments, expressing hope for rational communication and negotiation to seek an appropriate consensus, thus protecting democratic freedom, constitutional order, and citizens' rights to relief.
