TAIPEI (TVBS News) — The Examination Yuan (考試院), Taiwan's civil service commission, petitioned the Constitutional Court (憲法法庭) for a constitutional interpretation and provisional disposition on Thursday (Jan. 8), challenging the pension reform law passed by the Legislative Yuan (立法院), Taiwan's legislature, in December. The Examination Yuan argues that the law threatens the sustainability of the pension fund and violates principles of generational justice and public interest.

The Legislative Yuan approved amendments to the Civil Service Retirement Act (公務人員退休資遣撫卹法) on Dec. 12, 2025. These amendments will halt the pension cuts for civil servants starting in 2024 and adjust monthly pensions based on a 5% growth rate in the consumer price index. The Examination Yuan claimed that this law undermines its constitutional duties and has filed a petition under Article 47 and Article 43 of the Constitutional Court Procedure Act (憲法訴訟法).

 

The Executive Yuan (行政院), Taiwan's cabinet, also filed a petition on Dec. 31, 2025, asserting that the law's legislative process violated constitutional procedures and its content contradicts Article 70 of the Constitution (憲法). The Executive Yuan stated that the law infringes on its budgetary rights and could lead to the premature bankruptcy of the pension fund, creating generational injustice.

The Examination Yuan will continue to adhere to its constitutional powers and relevant legal provisions until the Constitutional Court delivers a verdict. Both the Examination Yuan and the Executive Yuan emphasize the urgency of resolving these constitutional issues to protect the pension fund's viability and uphold justice for future generations.
