TAIPEI (TVBS News) — In a significant move to uphold constitutional integrity, Premier Cho Jung-tai (卓榮泰) announced on Tuesday (May 28) that the Executive Yuan will request the Legislative Yuan to reconsider recently passed amendments if they pose constitutional challenges.

This statement came after the Legislative Yuan approved amendments to the Law Governing the Legislative Yuan's Power (立法院職權行使法) and the Criminal Law (刑法), sparking concerns from the government and the Democratic Progressive Party (DPP).

 

Cho criticized the Legislative Yuan for not adhering to legal procedures during the bill review process, emphasizing the Executive Yuan's commitment to protecting the Constitution.

The amendments, particularly those lacking a clear definition of "contempt of Congress," could complicate the executive team's ability to explain policies in the Legislative Yuan.

Cho highlighted that the revised provisions on personnel consent rights might interfere with the functioning of constitutional bodies or other legally established institutions.
 

The DPP's caucus whip, Ker Chien-ming (柯建銘), has announced plans to request a constitutional interpretation to address the amendments. Cho stressed that the Executive Yuan's goal in seeking reconsideration is not to escalate opposition but to find the broadest consensus through constitutional processes. He assured that the Executive Yuan would follow constitutional procedures to refer the amendments back to the Legislative Yuan, aiming to safeguard constitutional procedures.

This move underscores the ongoing debate over the balance of power and the protection of citizens' rights within Taiwan's (台灣) legislative framework. The government's effort to ensure that legislative changes do not overstep constitutional boundaries reflects its dedication to democratic principles and the rule of law.
